Am I a private individual or a professional?

The difference is about the nature of your activity, not the number of items you sell. You are a professional as soon as you sell as part of a declared economic activity.

You are most likely a professional if:

  • you buy to resell, or you make or produce what you sell;
  • you run a declared activity (sole trader, company, craftsperson, retailer, farmer, estate agent, etc.);
  • your sales are regular, organised and profit-driven.

You are a private individual if you occasionally sell personal belongings you no longer need, with no commercial intent.

Declaring the right status is a legal obligation and reassures buyers. When in doubt, choose the pro account. Our terms of sale set out this framework.
